The Department of State has recently released the November 2011 Visa Bulletin. This bulletin is issued on a monthly basis and summarizes the availability of immigrant numbers during the specified month. The availability of immigrant numbers specified by this bulletin, coupled with the date of the receipt and/or approval notices of the immigrant petitions governing the individual’s immigration documents, determines when a foreign born national becomes eligible to submit an application for permanent residence.
In order to determine whether or not you may be allotted a visa number for the month, check your priority date. Only those applicant who have a priority date earlier than the cut-off date indicated on the visa bulletin may be allotted a visa number.
For all family sponsored preferences with a chargeability to all areas of the world, the November visa number availability has moved up by one month.
For employment based 2nd preference (EB-2) with a chargeability to China and India, the November visa number availability has moved up from July to November. In the 3rd preference (EB-3) category, the visa cut off dates have moved forward only about two weeks for both Chinese and Indian nationals.
